New File Uploaded: Terry Malpass Brief
On November 26, 2007, Terry Malpass went to court in Kinston NC for a helmet citation. Unlike most NC helmet citations which are dismissed routinely by the DA, with no trial, NC v Malpass actually went to trial, and WON. Terry was kind enough to allow us all to benefit from the brief he used. This file is in Word format. There is also a NC v Malpass .pdf format if you like.
If you receive a helmet ticket in NC, please contest it. For help, go to Biker Court and be sure to log your ticket onto the Ticket Information Tracking System (TITS).

URGENT HELMET LAW ENFORCEMENT ALERT:
August 10, 2007 Raleigh NC Bikers USA and B.O.L.T.

NC Law Enforcement have begun ticketing for what they believe to be helmet statute violations, in different counties across the state. In most cases, they don’t have a leg to stand on in court. If you pay the fine, you are only helping them! Everyone must fight the helmet tickets in court or your freedoms may be forever lost. The court cases should be easily won! This is harassment. Are you going to wimp out and help the state put an end to your rights or are you a biker?
Please fight the tickets in court!
If you get a helmet ticket in Wake County, please call BOLT 919-342-0403. In Guilford County, contact Mark Infield, Editor of Full Throttle, 336-885-5400. Savvy volunteers in all counties and nearby states needed!
In South Carolina, please contact Fast Fred.
Please continue to check back at BOLT of the Carolinas. Will be posting info and actions we can take.

North Carolina Uniform Fines and Court Costs Document (.pdf)
NC Fine for a helmet law violation is $25 plus $75 court cost, regardless of whether you contest it or not. You should contest it! If we all contest it, we may be able to get the state to think twice before enforcing, because the courts are already too bogged down.
We advised the legislators this would happen!

I have spoken to Dave Doherty of Doherty & Nugent in Thomasville re the helmet deal. Dave is a rider. We talked at length about probable cause and the helmet issue. He has agreed to represent people for $50 as well as coach people with helmet tickets in the following counties: Surry, Forsyth, Davie, Davidson, Randolph, & Guilford. Dave can be reached at 336-472-7887. Please tell him Mark Infield and BOLT sent you!

NOTE: If there are NC attorneys, in other counties, who are willing and able to take on some helmet ticket cases with similar passion and commitment, please contact Jan, Editor of Bikers USA at 919-342-0403 or Mark Infield, Editor of Full Throttle of the Carolinas Magazine at 336-885-5400.
We’re gearing up to fight these tickets all over the state!  BOLT can help you find successful cases to draw upon. This is a Just and Right Cause which is much more than just about helmet tickets! We advised the legislature that their new bill, H563 will most likely be found unenforceable due to unconstitutional vagueness. One lawmaker, Faison, just scoffed and said “that is why we pay the judges the high dollars”. These are our rights to decide as responsible adults, and we are not willing to part with them when threatened with unconstitutional enforcement. We love our freedom, and it breaks our hearts to see lawmakers oppressively govern American adults, including many military veterans, like irresponsible children.

On 8/15/07, the Carolinas' Full Throttle Magazine wrote:
I have secured permission to add the name of ATTY Gary Poole (124 Timber Hill Pl., Chapel Hill, NC) for the counties of Orange, Chatham, & Durham. He has agreed to represent people for a nominal fee of $50. His phone number is 919-942-1181. His e-mail is: GaryPoole@mindspring.com.

BIKERS ORGANIZING TO FIGHT HELMET TICKETS IN THE NORTH CAROLINA COURTS
August 18, 2007 Raleigh, NC
Bikers take helmet tickets serious by announcing that development has begun on a robust system and database to be used by bikers in North Carolina, regardless of affiliation with any organization. All Motorcycle Rights Organizations are invited to play an equal role in the development and utilization of the Ticket Information Tracking System (TTS) at Biker Court. We will ask that motorcyclists who fight tickets log the details of their tickets. If you need any help in fighting the tickets we will do what we can to help. Until the system is completed, there is a simple and temporary database contributed by BOLT of the Carolinas.
With the temporary database, access is limited to members of the BOLT mailing list. However, when the Biker Court site is complete, access will be granted to key people in BOLT and CBA/ABATE, as well as special access permissions for attorneys who are willing to lead the way in helping to get the helmet laws recognized as unenforceable or unconstitutional.
